Real estate in Morocco: good news for new buyers
Changes have been made to positively impact the real estate sector. The time limit provided for in Article 573 relating to the introduction of legal action for lack of warranty is no longer limited to 365 days.
During a legislative session held in July, the House of Representatives unanimously adopted a bill amending and supplementing the Dahir of 9 Ramadan 1331, corresponding to 12 August 1913, forming the Code of Obligations and Contracts. This bill aims to amend and supplement Article 573 of the Code of Obligations and Contracts by modifying the limitation period for actions resulting from latent defects in real estate to increase it to two years from delivery and to increase it, in all cases, to five years from the date of sale.
