European justice confirms the end of the fishing agreement with Morocco

The Court of Justice of the European Union (CJEU) put an end this Friday to a long legal saga by definitively annulling the trade agreements, particularly those relating to fishing, concluded between the European Union and Morocco. This decision, which follows an appeal from the Polisario Front, confirms a previous judgment of the General Court of the EU.

At the heart of the dispute: the lack of consent of the Sahrawi people to these agreements. The CJEU ruled that the Polisario Front was indeed entitled to challenge these agreements. Although the Court clarified that this consent did not necessarily need to be explicit, it held that it could not be presumed in the present case.
