A Moroccan child sent back to Switzerland, his mother contests



While a mother obtained at first instance and on appeal the right to custody of her son, a judgment rendered by the Marrakech family court last July ordered the repatriation of the four and a half year old child. in Switzerland, considered as the “habitual place of residence of the child”. This decision is controversial.


During a press conference organized last Thursday at the initiative of the Ennakhil Association, Lamia, mother of one child, returned to this judgment. She said that at the suggestion of her ex-husband, the family, then residing in Switzerland, decided to settle in Morocco after the Covid-19 pandemic, reports The morning. They settled in Casablanca before moving to Marrakech. But things won’t go as planned. Without notifying her, her ex-husband returned to Switzerland with their child’s documents and then initiated proceedings to obtain sole custody. Last July, the Marrakech family court ordered the repatriation of the four and a half year old child to Switzerland, considered to be the child’s “habitual place of residence”.
